This comparative study of the data protection legislation frameworks across the East African Community maps legislation, distinguishing differences between existing and proposed data protection laws and trade laws within the East African Community. As part of the project's broader initiatives, the study makes a comparative analysis of data protection legislation across EAC partner states to identify legal gaps and make informed recommendations. It offers a comprehensive overview of data protection laws in EAC countries, delving into specific provisions for Kenya, Uganda, Rwanda, Tanzania, Burundi, Somalia, the Democratic Republic of the Congo, and South Sudan.
Additionally, the study explores relevant international agreements such as the EAC Legal Framework for Cyber Laws 2008, the Malabo Convention and the Common Market Protocol. Furthermore, the study investigates primary gaps in the legislation, examining approaches of other regional bodies (EU and ASEAN) in addressing differences in the data protection laws of partner states and provides preliminary recommendations for short and long-term measures to strengthen regional trade, cross-border data flows and cooperation.
